Difetto del prodotto, norme tecniche ed informazione sui rischi di danno alla salute

La decisione che si commenta si colloca nel solco di recenti pronunce in tema di difetto del prodotto ed onere probatorio gravante sul danneggiato; ma presenta spunti di novità in ordine al rapporto tra giudizio sul difetto e norme tecniche, da un lato, e circa il difetto di informazione, dall’altro, tracciando un collegamento tra omessa avvertenza sui possibili rischi di danno alla salute e responsabilità del produttore. The decision at issue is in line with the trend emerging from previous rulings of the Italian Supreme Court on the concept of defect of the product and burden of proof resting on the injured party; nevertheless it presents some novelties regarding the relationship between the assessment of the defect and technical standards, on the one hand, and about the defect of information, on the other hand, tracing a link between failure to warn about the possible risks of damage to consumers’ health and producer liability.
