The Common European Asylum System (CEAS) and the externalisation of migration control and management – a challenge to basic international refugee protection standards

This contribution examines the 2024 reform of the Common European Asylum System (CEAS), introduced through the New Pact on Migration and Asylum, focussing in particular on the role of externalisation in the so-called ‘comprehensive approach’ the New Pact proposes, which brings together the ‘internal’ and ‘external’ dimension of migration management. The contribution will first examine the discipline of Search and Rescue (SAR) operations; then the internal dimension of the Pact, specifically on the creation of the integrated border procedure, the (missed) reform of the Dublin system, and the discretionary nature of the solidarity mechanism. The contribution will finally analyse the external dimension of the Pact, namely how externalisation has become a structural pillar of EU asylum law. The analysis will highlight how these practices displace international obligations, and raise serious concerns about accountability, compliance with the principle of non-refoulement, and the erosion of refugee protection standards.
